BHR Affiliate Program Agreement

This Agreement is between BHR LLC (“Company”), a Vermont limited liability company, and the undersigned (“Affiliate”), effective on the date signed below.

1. Program. Affiliate may promote the Begini Howard Residency (the “Program”) using only the materials in the Promo Kit or content pre-approved by Company in writing. No other marketing content is permitted.

2. Commission. Company pays Affiliate 10% of tuition actually collected from each new enrollee attributed to Affiliate. Commissions are paid by ACH within five (5) days after funds have cleared. Refunds, reversals, or non-payment cancel or claw back the related commission. The Earn-Back tuition rebate is an earned program incentive, not a refund, and does not cancel or claw back a commission.

3. Attribution. Enrollees are attributed by Affiliate’s unique link/code and the “How did you hear about us?” application field. First affiliate identified controls; 60-day attribution window; Company’s tracking records govern in any dispute.

4. Marketing Rules (strict — violations forfeit commissions).

• No income or earnings claims, express or implied. Nothing about money made, lifestyle results, “quitting your job,” or specific outcomes — including in captions, comments, replies, and DMs.
• No guarantees of Associate-agreement placement, contract awards, or any result. The tuition rebate may be mentioned only via the verbatim Challenge sentence in the Promo Kit; the commission opportunity only with the Kit’s Required Disclosure.
• Disclose the paid relationship clearly and conspicuously in every post and message (“#ad” or “I earn a commission if you enroll”), consistent with the FTC Endorsement Guides.
• No spam, purchased lists, cold texts, or robocalls. No paid ads on Company or BHPE brand terms without written consent.
• No procurement-sensitive content. Never publish solicitation numbers, contracting officer names, agency correspondence, pricing, or anything implying U.S. Government endorsement.
• Affiliate is not an employee, agent, or representative of Company or of BHPE LLC and may not negotiate or make commitments for either.

5. Term & Termination. Either party may terminate at any time by written notice. Commissions validly earned before termination are still paid. Violations of Section 4 terminate this Agreement immediately and forfeit unpaid commissions.

6. Status & Tax. Affiliate is an independent contractor, responsible for its own taxes. A completed W-9 (or W-8, if foreign) is required before any payout.

7. Indemnity & Liability. Affiliate indemnifies Company against claims arising from Affiliate’s unapproved statements or unlawful marketing. Company’s total liability under this Agreement is capped at commissions paid to Affiliate in the prior six (6) months.

8. General. Vermont law governs. This is the entire agreement; changes must be in writing signed by both parties.
